1. Introduction

Welcome to PromptInspire. These Terms of Service ("Terms") govern your access to and use of PromptInspire, including our website, prompt discovery experience, AI image generation tools, account features, subscriptions, credits, and related services (the "Service").

PromptInspire is operated by the PromptInspire Team ("PromptInspire", "we", "us", or "our"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with permission from a parent or legal guardian.

The Service is not directed to children under 13, and you may not use the Service if applicable law prohibits you from doing so.

3. Accounts

You may need an account to use certain features, including image generation, favorites, generation history, credits, subscriptions, or billing settings.

You agree to provide accurate account information, keep your login credentials secure, and notify us promptly if you believe your account has been accessed without permission. You are responsible for activity that occurs under your account.

4. The Service

PromptInspire helps users explore AI image prompt ideas, save inspiration, and generate images using supported AI models. Some features may depend on third-party AI, storage, authentication, analytics, infrastructure, or payment providers.

We may change, suspend, or discontinue parts of the Service at any time. We may also set usage limits, modify available models, change credit costs, or restrict access where needed for security, legal compliance, provider limitations, or platform stability.

5. Subscriptions, Credits, and Payments

PromptInspire may offer paid subscriptions or credit-based plans. Credits can be used for supported AI generation features. Credit costs may vary by model, quality, image count, aspect ratio, or other generation settings.

By purchasing a paid plan, you authorize our payment providers to charge the applicable fees, taxes, and recurring subscription amounts. Subscription credits are granted according to the plan shown at checkout. Unless otherwise stated, subscription access continues until the end of the current billing period after cancellation.

Credits have no cash value, are not a stored-value account, and cannot be transferred, resold, exchanged, or redeemed for cash except where required by law or expressly stated in our Refund Policy.

Refund requests are handled under our Refund Policy.

6. User Content and Generated Output

"User Content" means content you submit to the Service, including prompts, uploaded reference images, text, feedback, and settings. "Generated Output" means images or other results generated through the Service.

You retain any rights you have in your User Content and Generated Output. You grant PromptInspire a limited, worldwide, non-exclusive license to host, process, transmit, store, display, and otherwise use your User Content and Generated Output only as needed to provide the Service, operate account history, troubleshoot issues, enforce these Terms, prevent abuse, and comply with law.

PromptInspire does not claim ownership of your private User Content or Generated Output. We do not intentionally publish your private generations, and we do not use your private User Content or Generated Output to train AI models unless you separately give us permission.

You are responsible for ensuring that your User Content, Generated Output, and use of the Service comply with these Terms and applicable law.

7. Content Safety Rules

You may not use the Service to create, upload, request, store, or share content or activity that is illegal, harmful, abusive, deceptive, rights-violating, NSFW, sexually explicit, sexually suggestive, sexualized, face-swap, deepfake, non-consensual likeness manipulation, or intended to bypass safety controls.

We may remove content, block generations, suspend accounts, limit credits, or report activity when we reasonably believe the Service is being misused.

Detailed content and conduct rules are provided in our Acceptable Use Policy, which also governs your use of the Service.

8. Third-Party Services and AI Providers

The Service may rely on third-party providers for AI generation, authentication, payments, analytics, hosting, storage, email, and security. Your use of those features may be subject to third-party terms and policies.

PromptInspire provides an independent interface and workflow layer for supported AI models. We are not affiliated with, endorsed by, or sponsored by OpenAI, Google, Black Forest Labs, or other model providers unless expressly stated.

AI generation can be unpredictable. Generated Output may be inaccurate, incomplete, offensive, similar to third-party content, or unsuitable for your intended use. You should review Generated Output before relying on it, publishing it, or using it commercially.

9. Intellectual Property

PromptInspire, including our website, software, design, branding, prompt gallery organization, interfaces, and related materials, is owned by PromptInspire or our licensors and is protected by intellectual property laws.

These Terms do not grant you ownership of the Service or permission to copy, sell, reverse engineer, scrape, or misuse the Service except as allowed by the Service's normal functionality.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, share, and protect information.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access if we believe you violated these Terms, created legal or security risk, abused the Service, failed to pay required fees, or used the Service in a way that could harm PromptInspire, users, third parties, or providers.

Termination does not automatically entitle you to a refund. Refund eligibility is governed by our Refund Policy.

12. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, PromptInspire disclaims warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted availability, and error-free operation.

We do not guarantee that the Service or Generated Output will meet your requirements, be available at all times, be free from defects, or be legally suitable for any particular use.

13. Limitation of Liability

To the fullest extent permitted by law, PromptInspire will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, business interruption, or unauthorized access arising from or related to your use of the Service.

To the fullest extent permitted by law, PromptInspire's total liability for any claim related to the Service will not exceed the amount you paid to PromptInspire for the Service in the three months before the event giving rise to the claim, or USD $100 if you have not paid us.

14. Indemnification

You agree to defend, indemnify, and hold harmless PromptInspire from claims, damages, losses, liabilities, costs, and expenses arising from your User Content, Generated Output, use of the Service, violation of these Terms, or violation of applicable law or third-party rights.

15. Applicable Law and User Rights

PromptInspire is intended for users in multiple regions. These Terms apply to the fullest extent permitted by applicable law. Nothing in these Terms limits consumer rights, privacy rights, refund rights, or other mandatory protections that cannot be waived under the laws that apply to you.

If a dispute arises, please contact us first so we can try to resolve it informally.

16. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised effective date. Your continued use of the Service after changes take effect means you accept the updated Terms.
